Pastor Burale’s defamation case faces challenge as Rozina presents emails and witnesses

Gospel singer Rozina Mwakideu has responded strongly to a defamation lawsuit filed by her ex-husband, Pastor Robert Burale, calling the case baseless and a waste of the court’s time.

Burale had accused Rozina of making damaging remarks that painted him as immoral and dishonest during an interview she did with her brother, media personality Alex Mwakideu.

However, Rozina has stood by every statement she made, saying her words were truthful and backed by real evidence.

In a detailed 36-page affidavit submitted to the court, Rozina explained that her intention was never to defame her former husband but to share her personal experience from a failed marriage.

She asked the court to dismiss the suit, arguing that everything she said in the interview was accurate.

“Everything I said in that interview is the truth, the whole truth, and nothing but the truth,” she stated in her response.

To support her position, Rozina attached several pieces of evidence, including emails, text messages, and payment receipts.

Among the documents presented, an email dated August 22, 2018, showed Rozina warning Burale to stop discussing their past relationship publicly on social media platforms.

Another email from December 12, 2013, revealed her frustrations during their marriage and her decision to seek a divorce. She stated that these records clearly demonstrated the truthfulness of her statements and her right to speak about her own experiences.

Rozina further argued that her remarks fell under the protection of Article 33(1)(a) of the Kenyan Constitution, which guarantees every citizen the right to freedom of expression. Her lawyer, Ochiel Dudley, supported her position, saying that Burale’s demands, including the removal of the viral interview and the restriction of public discussions around it, were unrealistic and unenforceable.

He added that such attempts could set a dangerous precedent for silencing individuals who speak about personal experiences involving public figures.

The gospel artist also disclosed that five women had approached her, expressing readiness to testify in her defence. These women claimed they too had negative experiences with the pastor and were willing to share their accounts in court. Rozina emphasized that her tone in the interview was respectful and that she had no malicious intent.

According to her, the discussion was an honest reflection of her life journey and the lessons she learned from a difficult relationship.

While the matter continues to attract public attention, the court has not yet issued a ruling. Both parties remain firm in their positions, with Rozina insisting she only spoke the truth and Burale maintaining that his reputation was unfairly damaged.
