Fresh charges hit Former Kiambu Governor Waititu as he serves 12-year jail term

Former Kiambu Governor Ferdinand Waititu’s troubles continue to deepen as he faces new criminal charges while already serving a lengthy prison sentence.

The latest case adds to his growing list of legal challenges, showing that his journey through the courts is far from over.

The former county boss, currently serving a 12-year jail term at Kamiti Maximum Prison for offences involving conflict of interest and dealing with suspect property, was presented with new charges on November 11.

The fresh case revolves around remarks he allegedly made during a public event at Ruiru Stadium in Kiambu County on September 29, 2024.

Prosecutors claim that his speech was inflammatory and could have incited public unrest.

According to court documents, Waititu allegedly made statements criticizing the impeachment proceedings against former Deputy President Rigathi Gachagua.

During the gathering, he is said to have suggested that if Gachagua were to be removed from office, then President William Ruto should also step down.

The prosecution argued that these words were not only politically charged but also intended to stir tension among various groups, including hustlers, market traders, boda-boda riders, and members of the clergy.

The Director of Public Prosecutions (ODPP) has taken the matter seriously, stating that Waititu’s conduct may have violated Section 94.1 of the Penal Code, which prohibits utterances likely to cause public disorder or unrest.

A hearing for the case has been set for next week, where Waititu is expected to appear via a video link from Kamiti Prison.

This new development piles onto his existing woes, as his previous attempts to secure freedom have been repeatedly denied by the courts.

In September 2025, his legal team made another attempt to secure his release, but the court dismissed the application after he failed to raise the necessary bank guarantee required for his bond.

The same outcome had followed three earlier appeals, with High Court Judge Lucy Njuguna ruling that such repeated applications were merely aimed at delaying the course of justice.

Earlier in the year, after his February conviction, Waititu was granted a temporary reprieve when he was allowed to post a Ksh53 million bond pending the determination of his appeal.

However, his hope for release quickly faded when the court upheld the conviction, confirming both his prison term and a 10-year ban from holding any public office

The new charges threaten to extend his legal battles even further. For a once-powerful politician who once wielded great influence in Kiambu County and national politics, his fall from grace now appears complete. With another court date ahead and mounting legal hurdles, Ferdinand Waititu’s future looks increasingly uncertain.
