Nairobi Governor Mike Sonko will be charged afresh next Monday September 14 after the Directorate of Public Prosecution (DPP) amended the charge sheet to include an abuse of office charge.
Sonko is facing economic crimes, unlawful acquisition of property and irregular payments charges.
The DPP claimed that the governor abused his office by demanding Ksh10 million bribe from Web Tribe Ltd to facilitate payments to the company by the Nairobi County Government.
“Between on or about January 10, 2019, and January 19, 2019, in Nairobi City County within the Republic of Kenya, being the Governor of Nairobi County Government, in abuse of your office improperly conferred a benefit to yourself by demanding Ksh.10,000,000 from Web Tribe Limited through ROG Security Limited as an inducement to facilitate payments to Web Tribe Ltd by Nairobi City County Government,” read the amended charge sheet.
On Monday September 7, the anti-corruption court noted that the case which will take 28 days will be allocated five hours daily with no adjournments allowed.
Sonko was to take plea on Monday but his lawyers objected, saying that they had been ambushed and needed more time to look at the charge sheet.
The court obliged the lawyers’ request and deferred plea-taking to Monday, September 14, 2020.
20 witnesses are lined up for the case in which the Nairobi county is said to have lost Ksh.357million in dubious deals.
The court has since directed the prosecution to give a chronology of how witnesses will be called to the stand, seven days to the hearing.
Sonko, in count one, is charged – alongside Fredrick Odhiambo alias Fred Oyugi, ROG Security Limited and Antony Otieno Ombok alias Jamal – of conspiring to commit an offence of corruption and dealing with suspect property in the sum of over Ksh.14 million in respect of a contract
The embattled Nairobi governor is also charged with another count of conflict of interest where he is alleged to have received Ksh.8.4 million from Fredrick Odhiambo alias Fred Oyugi, T/A Yiro Enterprises, through ROG Security Limited.
