According to Citizen Digital, senior security authorities in Kisii have confirmed that the MP is the primary suspect in an assault charge filed on Thursday, November 27 by 36-year-old Astariko Enock Omariba Moriasi.
Detectives in Kisii disclosed that Kibagendi has the option of voluntarily presenting himself to authorities to help speed up the investigation.
The victim, who appears in the viral video being repeatedly hit, informed detectives that he was attacked while eating breakfast at the eatery.
According to a report from the Kisii DCI offices, Omariba stated that he was seated alone when a man entered and assumed a position immediately opposite him.
Kibagendi entered the restaurant and proceeded directly to his table.
The video shows the MP gesturing at Omariba before the dispute becomes physical.
What happened next has caused widespread indignation and put the politician under close scrutiny.
The footage shows the MP kicking Omariba in the chest before seizing him by the neck.
Staff and diners, surprised by the unexpected escalation, rush in to separate the two, but the assault continues despite their efforts.
The video shows him striking another patron who went up to intercede before the two men exchanged words and Kibagendi walked away.
Omariba later told police that the MP had questioned him about interfering with his private matters just before the assault.
“He stormed in straight at me, shouting that I must respect him…and to leave his girlfriend alone,” he reportedly said.
He claimed that the attack injured him and that the altercation was the result of a personal dispute involving a love triangle.
