Former KEMSA CEO Andrew Mulwa faces perjury charges over ksh 31.5 million cover-up

Former Kenya Medical Supplies Authority (KEMSA) CEO Dr. Andrew Mulwa is once again in the spotlight, facing damning accusations of perjury in a legal dispute involving Ksh 31.5 million.

Cyprian Is Nyakundi, a vocal critic of corruption in public offices, recently brought this matter to public attention, exposing yet another chapter in Mulwa’s scandal-ridden career.

This new legal trouble comes after Mulwa was dismissed from KEMSA following allegations of tampering with tender specifications in the infamous Ksh 3.7 billion mosquito nets procurement fiasco.

Cyprian Is Nyakundi highlighted the gravity of the perjury claims, revealing that they revolve around a replying affidavit filed by Dr. Mulwa on July 18, 2024.

In the document, Mulwa denied that a meeting had occurred on March 19, 2024, between KEMSA officials and lawyer Titus Makhanu.

The meeting was reportedly to discuss the settlement of legal fees.

However, Makhanu has countered this denial with evidence, including entries in KEMSA’s visitor’s book and CCTV footage, both of which confirm the meeting took place.

According to Makhanu, this evidence directly contradicts Mulwa’s affidavit, raising serious questions about his credibility.

In his formal complaint to the Directorate of Criminal Investigations (DCI), Makhanu accused Dr. Mulwa of deliberately misleading the court to avoid honoring KEMSA’s agreement to pay the legal fees.

Further supporting his claims, Makhanu provided an SMS from KEMSA’s Finance Officer, Christine Mwangi, which indicates that the minutes of the meeting are stored in the organization’s legal office.

This has added weight to the advocate’s argument that Mulwa attempted to suppress critical evidence, obstruct justice, and undermine court proceedings in the case labeled HCCOMMMISC/E195/2024.

The allegations of perjury come as no surprise to critics like Cyprian Is Nyakundi, who have consistently pointed out the rampant corruption and financial mismanagement within KEMSA.

Mulwa’s tenure has been marked by controversies that have tarnished the institution’s reputation and severely impacted the healthcare sector.

Observers argue that the mismanagement under his leadership exemplifies a pattern of negligence and unethical practices that have plagued the organization for years.

This case not only raises questions about Dr. Mulwa’s integrity but also exposes the systemic failures at KEMSA, where public funds have repeatedly been misused.

As the the relevant bodies investigates these new claims, the public is reminded of the billions lost during Mulwa’s tenure, further eroding trust in KEMSA’s ability to fulfill its mandate.

Should Dr. Mulwa be convicted of perjury, he will face severe legal consequences, further cementing his reputation as a symbol of corruption and mismanagement.

Cyprian Is Nyakundi’s exposé serves as a reminder of the need for accountability and transparency in public institutions.

This case, once resolved, could serve as a warning to other leaders who misuse public resources for personal gain, but it also underscores the urgent need to reform institutions like KEMSA to prevent such scandals from recurring.
