Court of Appeal revives fraud case against CS Kabogo in shocking family dispute

Cabinet Secretary for Information, Communications, and the Digital Economy, William Kabogo, is caught in a legal fight with his uncle, Kimani Kabogo, over a Ksh 380 million land dispute.

The matter involves claims of fraud and breach of trust, with Kimani stating that he discovered the alleged fraud in 2006. He later took legal action in 2017, seeking damages, but the High Court dismissed the case due to the statute of limitations under the Limitation of Actions Act.

However, the Court of Appeal has now ruled that the case should be heard again by a different judge, opening up the dispute once more.

According to him, the property in question was obtained through a private treaty with NIC Bank after the bank sold it to recover a loan owed by Kenya Modern Digitals Ltd, which was guaranteed by Kimani.

This explanation, however, does not satisfy those questioning the legitimacy of the transactions, especially since the matter has now returned to court despite the previous dismissal.

The Court of Appeal’s decision indicates that the High Court may have erred in its ruling, making it necessary to re-examine all the details of the case.
