Court lifts orders blocking arrest of county governors, paving way for prosecutions

The Kiambu High Court has set aside temporary orders that had previously stopped the arrest and detention of county governors, allowing investigative agencies to proceed with ongoing corruption and misconduct cases involving senior county officials.

In its ruling, the court emphasized that constitutional accountability applies to all public officers without exception. It noted that the earlier orders had interfered with investigations and hindered law enforcement agencies from carrying out their constitutional duties.

The case arose from applications seeking to restrain police and anti-corruption officers from arresting certain governors who were under investigation for alleged abuse of office, procurement irregularities, and other financial misconduct claims.

The court observed that granting blanket protection from arrest would undermine the rule of law and weaken oversight institutions.

With the lifting of the orders, agencies such as the Ethics and Anti-Corruption Commission and the Directorate of Criminal Investigations are now free to pursue their mandates, provided they operate within the law and respect due process.

The court also cautioned that any arrests or prosecutions must be supported by sufficient evidence and conducted in accordance with constitutional safeguards.

Legal analysts have described the decision as a key moment in reinforcing accountability within devolved government structures.

They argue that the ruling reaffirms the principle that holding public office does not grant immunity from investigation or prosecution.

However, some political actors have expressed concern over potential misuse of enforcement powers, urging authorities to ensure that investigations are not driven by political interests. They have called for fairness, transparency, and adherence to legal procedures in handling the affected cases.

The matter will now proceed in lower courts where the substantive allegations against the governors will be examined. The ruling is expected to influence how future cases involving high-ranking county officials are handled, especially in relation to arrest and prosecution procedures.
