Havi links high-profile property dispute to alleged judicial corruption by Mong’are

Nelson Havi has publicly accused Lady Justice Josephine Mongare of corruption in several cases, claims he has been sharing through social media while calling for action from authorities.

Havi, a former president of the Law Society of Kenya, introduced the term “JuriPESA” to describe what he alleges is bribery within the judiciary. He has asked members of the public to share any experiences they may have had under Justice Mongare, saying he intends to bring such claims to light.

His main allegations are linked to a property dispute involving former Cabinet Secretary Raphael Tuju and the East African Development Bank. The case concerns a large debt tied to properties in Karen.

In March 2026, the Ethics and Anti-Corruption Commission arrested several individuals, including former judge Joseph Mutava and a lawyer.

They were accused of seeking about Ksh 10 million to influence the outcome of the case in favor of Tuju.

Havi claimed that Mutava told investigators he was collecting the money on behalf of Justice Mongare, who was handling the matter in the High Court’s Commercial and Tax Division.

He also alleged that one of the arrested individuals said he had a personal relationship with the judge and was acting for her.

These claims have not been proven in court.

In addition, Havi referred to a separate case from his past, where he alleged that an agent linked to the judge asked his clients for Ksh 5 million. He claimed the full amount was not delivered and that the outcome of the case later went against his clients.

He further stated that she ignored a directive from the Court of Appeal of Kenya and that a complaint he filed was cleared by the Judicial Service Commission under questionable circumstances.In response, Justice Mongare moved to the High Court of Kenya and obtained conservatory orders on March 19, 2026.

The orders stopped the EACC, police, and the Attorney General from taking any action against her in relation to her judicial duties.

The court said complaints against judges should be handled by the JSC to protect judicial independence.

Mongare denied all the claims and described the probe as selective.

Havi has criticized the decision, questioning why investigations should be blocked if there is nothing to hide. He has called on lawyers to avoid appearing before her and has continued to demand that she either clears her name or faces action.
