Government steps in to help late George Magoha family recover missing Nairobi title deed

The government has committed to assisting the family of the late Former CS George Magoha in locating a missing title deed and official land register associated with a valuable property in Nairobi.

His wife, Odudu Barbara Magoha, who is recognized as the court-appointed legal administrator of his estate, has officially reported the loss to Kenya’s Land Registry, leading to a formal response from the government.

In a Gazette Notice issued on February 21, the government approved her request and her assurance to safeguard against any financial repercussions that may arise in the future.

The property in question is recorded as L.R. No. 3734/1845, located in Nairobi, with its official ownership record reported as lost or destroyed.

Barbara Magoha has requested the government to reconstruct an entirely new official land register, effectively replacing the one that has gone missing from the Land Registrar’s files.

The government granted her request in accordance with Section 33(5) of the Land Registration Act, which outlines a legal process for replacing lost or destroyed land ownership documents.

As part of the application approval, Barbara Magoha entered into a binding indemnity agreement, which holds her personally responsible to compensate the government if the reconstruction process leads to any financial issues for others.

The government has also published a public notice, allowing a strict 60-day period for anyone to come forward and formally contest if they believe they have any claim to the property.

This 60-day timeframe serves as an important legal measure to protect any individuals who may possess the original deed or hold an undisclosed legal interest in the Nairobi land parcel.
